The High Court of Cassation and Justice dismissed as inadmissible the joined preliminary ruling requests from two Courts of Appeal concerning the interpretation of Article 85(2) of Law No. 303/2004 on the status of judges and prosecutors, as amended by Framework Law No. 153/2017 on public-sector pay, and thus did not rule on the merits of the two legal questions posed. The dispute involves the recalculation/update of service pensions for retired judges and prosecutors, specifically whether certain allowances (such as merit-based increments and seniority bonuses) that were later absorbed into the gross monthly salary of active judges/prosecutors must be added to the base used for calculating the service pension, and whether the 15% doctoral degree bonus for a retired prosecutor should be applied according to the percentage in force at retirement or the fixed amount set by Framework Law No. 153/2017. Under Article 521(3) of the Civil Procedure Code, the dismissal is binding, and the prior court decisions in the underlying cases remain unaffected by this ruling.
