Referral on judicial auxiliary salary derogations dismissed as inadmissible
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling on questions of law submitted by the Sibiu County Court, thereby leaving the lower court to resolve the underlying dispute without binding guidance from the supreme court. The case concerned a civil or administrative dispute regarding the salary structure of judicial auxiliary staff, specifically whether the special provisions of Law No. 567/2004 could derogate from the general public sector salary framework established by Framework Law No. 153/2017 (Annex VIII) to allow base salaries exceeding standard pay scales, and whether such application was subject to restrictions imposed by Emergency Government Ordinance No. 99/2023 concerning the settlement of arrears by public institutions. The decisive legal basis involved the interplay between Article 902(1) of Law No. 567/2004, Article 9 of Framework Law No. 153/2017, and Article 1(2) of OUG No. 99/2023, with the Supreme Court's procedural decision under Article 521(3) of the Code of Civil Procedure effectively blocking the requested clarification on these statutory conflicts.
