The High Court of Cassation and Justice, acting through its panel for resolving legal questions, dismissed the preliminary reference submitted by the Brașov Court of Appeal as inadmissible. The dispute concerned whether judicial assistants, classified under the "Justice" budgetary function family, are entitled to placement allowances and associated rights at the maximum salary level of prosecutors from the National Anti-Corruption Directorate and the Directorate for Investigating Organized Crime and Terrorism, particularly given prior judicial decisions granting such increases to colleagues and the argument of equal pay for equal work. The Court rejected the request without addressing the substantive legal question, thereby leaving the lower court to resolve the individual cases without binding uniform interpretation. The admissibility rejection stands as the final operative outcome, governed by the procedural requirements for preliminary references under Article 521(3) of the Civil Procedure Code, which mandates that such inquiries meet specific criteria of legal uncertainty and relevance for the resolution of pending cases.
