Public sector overtime compensation: waiver of mandatory pre-submission request for compensatory leave under OUG 114/2018
Legislator summary
AI generatedThe Supreme Court of Romania, acting as the body for unifying the law, upheld the preliminary reference from the Bucharest County Court and established that the prior written application for compensatory leave is not a mandatory procedural requirement for public officials with special status to claim payment for overtime hours. The case concerned a dispute over the procedural prerequisites for claiming overtime compensation in the public sector, specifically whether an employee must request time off within 60 days of the work performed to be eligible for monetary payment. The court ruled that under Article 35(3) of Emergency Governmental Ordinance No. 114/2018 (as amended) and Article II(3), second sentence, of Emergency Governmental Ordinance No. 130/2021, the absence of a pre-existing written request for compensatory leave does not bar the right to receive financial remuneration for supplementary hours worked.
