The High Court of Cassation and Justice, acting as the full panel for the resolution of legal issues, admitted the preliminary reference raised by the Braila Tribunal and established a mandatory interpretation of domestic violence legislation. The dispute concerned whether a respondent to a maximum-duration protection order must prove the fulfillment of specific conditions under Article 49(2) of Law No. 217/2003 in order to file a request for the replacement of established measures. The Court ruled that such proof is not a prerequisite for formulating the request, thereby favoring the respondent's ability to initiate the proceeding, and clarified that the replacement request must be adjudicated strictly according to the procedure set forth in Article 49(3). This decision, issued under Article 521(3) of the Code of Civil Procedure, provides a binding interpretation of Article 49 of the Law for the Prevention and Combating of Domestic Violence.
