The High Court of Cassation and Justice dismissed as inadmissible a referral from the Brașov Civil Court regarding a preliminary question of law concerning the calculation of the 75% allowance for exceptionally hazardous working conditions for budgetary health and social assistance staff under the 2017 Framework Law on Salaries of Public Personnel. The dispute centered on whether the specific allowance percentage mandated by the 2018 Government Decision violated principles of equality and non-discrimination as established in the Framework Law and international regulations, with the lower court seeking clarification on the legal interpretation of these conflicting provisions. The Supreme Court rejected the request to issue a preliminary ruling, thereby leaving the dispute to be resolved by the lower instance without establishing a unified judicial interpretation on the specific allowance criteria.
