The High Court of Cassation and Justice dismissed as inadmissible the request for legal clarification filed by the Argeș Court of Appeal regarding the classification of specific salary allowances. The dispute concerned whether an indemnity provided under Emergency Government Ordinance No. 68/2008, Art. 5(7), constitutes a salary income for budgetary sector personnel as defined by the Framework Law No. 153/2017, Art. 7(m), and whether such income is capped at the monthly allowance levels for vice-mayors or vice-presidents of county councils, subject to the additional limits under Art. 16(2) and budgetary constraints under Art. 11(4) of the Framework Law. By rejecting the referral as inadmissible, the court determined that the issue did not meet the procedural requirements for a final decision on a question of law under Art. 521(3) of the Code of Civil Procedure, leaving the lower court's assessment pending further clarification.
