Pension revision eligibility under Law No. 263/2010 for post-retirement judicial recognition of pre-retirement salary rights
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the preliminary ruling request and issued a mandatory interpretation stating that Article 107(1) of Law No. 263/2010 applies to pensioners who, after retirement, obtain a final judicial decision and employer certification recognizing unpaid salary rights attributable to the pre-retirement period. The dispute concerned whether such retroactive salary recognitions trigger a mandatory pension review under the Public Pension System, specifically for former magistrates. The Court established that the application of Article 107(1) results in paying the difference between the previously established pension and the recalculated pension amount starting from the date of retirement, subject to the limitations in Article 107(2), thereby defining the substantive rights and procedural scope for revision cases involving post-retirement salary adjustments.
