The High Court of Cassation and Justice, sitting as the Complete Bench for resolving legal issues, admitted the referral from the Arad Tribunal and established that the right to a monthly rent compensation does not extend to military personnel who have entered into mortgage credit contracts for the construction of a housing unit; the court simultaneously rejected as inadmissible the referral from the Ploiești Court of Appeal regarding the temporal applicability of compensation rules for prison police officers. The dispute centered on the interpretation of statutory provisions governing housing benefits for uniformed personnel, specifically whether mortgage loans for new construction qualify for the monthly rent compensation provided under the military status law. The decisive legal basis for the operative decision was Articles 201(3), (21), (22), (23), and (25) of Law No. 80/1995 on the status of military personnel, which the court construed to exclude such compensation for credits aimed at constructing a residence, while the rejected referral involved Articles 111 of Law No. 145/2019 and Order No. 482/C/2020 concerning the specific conditions for rent and mortgage rate compensation for prison police.
