The High Court of Cassation and Justice dismissed as inadmissible the request for clarification of law filed by the Sibiu Court of Appeal, leaving the lower court’s pending decision to resolve the specific factual dispute. The referral concerned the interpretation of Law No. 17/2000, specifically whether an informal caregiver’s right to the statutory allowance is contingent upon the prior approval of the local budget containing the necessary funds, or if the care contract can be validly concluded before such budgetary approval. The Court did not rule on the merits of the legal question but instead determined that the referral did not meet the procedural admissibility requirements, thereby denying the lower court the requested legal guidance.
