Interpretation of daily allowance vs. risk allowance for international missions under Government Order 1,086/2004
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Bucharest Court of Appeal, thereby leaving the lower court without the requested interpretation and maintaining the procedural status quo. The dispute concerned the interpretation of specific allowance regulations for personnel on international missions, specifically challenging whether the daily allowance (diurna) stipulated in Article 1(1) of Government Order No. 1,086/2004 corresponds to the "risk allowance" for the Kosovo Eulex mission or overlaps with the distinct benefits provided under Articles 1(3) and 1(4) of the same order, including amendments from Government Order No. S-639/2008. The decisive legal basis for the dismissal was the inadmissibility of the referral itself, while the Court noted that its decisions on matters of right are binding pursuant to Article 521(3) of the Civil Procedure Code, although this procedural rejection did not result in a substantive clarification of the conflicting normative provisions regarding military personnel entitlements.
