The High Court of Cassation and Justice dismissed as inadmissible two requests for a preliminary ruling on questions of law, thereby leaving the lower tribunals' pending decisions on their original merits without establishing a new binding legal interpretation. The dispute centered on whether labor code provisions regarding overtime, weekend, and holiday pay (Articles 120(1), 123(1), 137(3), and 142(2) of the Labor Code and Article 21(4) of Law No. 153/2017) apply to personal assistants of disabled individuals, and specifically if providing care on rest days constitutes compensable overtime, or if the specific contractual terms under Law No. 448/2006 (Articles 37, 38, and 39) supersede general labor standards for employees working at the beneficiary's domicile without a legal obligation of care. The court did not resolve the substantive legal questions but declined to answer them based on procedural inadmissibility under Article 521(3) of the Code of Civil Procedure.
