The High Court of Cassation and Justice dismissed as inadmissible the referral from the Bucharest Court of Appeal to resolve a uniform legal question regarding labor compensation, leaving the lower court to adjudicate the specific employment claims without a binding clarification from the supreme instance. The underlying dispute concerned whether military personnel with access to classified information are entitled to a flat 15% wage surcharge for maintaining confidentiality under the Government Ordinance approving Law No. 444/2006, regardless of the specific classification level indicated in their security clearance. The decisive procedural basis for the outcome was Article 521(3) of the Civil Procedure Code, which the Court applied to reject the referral, thereby preventing the creation of a mandatory interpretation on whether the statutory surcharge applies uniformly irrespective of the hierarchy of classified access.
