The High Court of Cassation and Justice dismissed as inadmissible the reference for uniform interpretation submitted by the Pitești Court of Appeal, leaving the lower court's procedural handling of the underlying civil case unaffected by a prior ruling. The dispute concerned the interpretation of the Framework Law No. 153/2017 regarding the payment of public sector salaries, specifically whether educational staff are entitled to hazardous working conditions allowances and from what date, with the appellant arguing the allowance should accrue from the entry into force of the Law (January 1, 2018) or the issuance of certification bulletins, while the respondent argued it applies only from the date salaries equaled the 2022 statutory levels. The court ruled on admissibility without interpreting the substantive interaction between Article 23 of Law No. 153/2017, Article 13 of Annex I, and the Framework Regulations approved by Government Decision No. 34/2018, leaving the contested legal issues unresolved at this level.
