The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Bucharest Court of Appeal regarding the commencement date of the statute of limitations for criminal liability. The dispute concerned whether, in cases of a single offense under Article 289 of the Penal Code (bribery) involving multiple alternative modalities committed on different dates, the limitation period begins from the commission of the first or the last modality, and whether such conduct constitutes a continued offense. The court’s decision resolves the procedural challenge without establishing a substantive legal rule, leaving the lower court to determine the applicable limitation period based on existing law; the decision becomes binding upon publication in the Official Monitor.
