The High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling on a question of law submitted by the Court of Appeal, leaving the lower court's proceedings to continue without a binding interpretation from the supreme court. The dispute concerned the calculation of the basic salary level for newly appointed public officials in vacant positions who were already in service after the entry into force of the Framework Law No. 153/2017 on public sector remuneration, specifically whether the salary should be determined under Article 39(1) and (4) or Article 39(2) of that law when no similar function exists within the institution. The decisive legal basis for the dismissal was the procedural requirement under Article 521(3) of the Civil Procedure Code, which governs the admissibility conditions for referrals to the Plenary for resolving questions of law.
