The High Court of Cassation and Justice dismissed as inadmissible the preliminary reference raised by the Bucharest District Court, leaving the lower court without a binding interpretation from the supreme instance. The dispute concerned an employment and social security conflict where a claimant sought the recalculation of a gratitude allowance under Law No. 341/2004, specifically arguing for the application of a 1.1% coefficient based on the average gross salary utilized for the 2015–2024 period. The case centered on the legal basis for updating this specific revolutionary gratitude benefit, but the supreme court determined that the reference to resolve this chestiune de drept did not meet the admissibility requirements under procedural law, thereby refusing to issue a precedent-setting ruling on the calculation methodology.
