Admissibility of reference on whether public sector harmful condition and electromagnetic wave allowances bypass statutory budgetary salary caps
Legislator summary
AI generatedThe High Court of Cassation and Justice rejected as inadmissible the reference for uniform application of law submitted by the Bucharest Court of Appeal, thereby denying the requesting appellate court's request for a preliminary ruling on whether specific employment allowances are payable regardless of budgetary limitations. The dispute concerned the interpretation of the interplay between Government Decree No. 34/2018 (regarding educational staff) and Government Decree No. 917/2017 (regarding administrative staff) on the entitlement to harmful working conditions and electromagnetic wave surpluses, specifically whether these payments must be granted even if they exceed the personnel expenditure limits set by the approved revenue and expenditure budget. The legal basis for the decision rested on the procedural framework of Article 25 of Law No. 153/2017 governing the salary of public sector personnel, combined with the procedural rules for resolving conflicts of law in civil procedure, resulting in the inadmissibility of the sesizare and leaving the original procedural posture unresolved by the supreme court.
