The High Court of Cassation and Justice dismissed as inadmissible the referral by the Bucharest Court of Appeal for a preliminary decision on a question of law. The dispute concerned the interpretation of Article 49(3) of the Parliamentary Statute Law No. 96/2006, specifically whether the age-limit indemnity for former members of parliament, suspended following Constitutional Court Decision No. 261/2022, should be recalculated according to current legal norms upon resumption of payment or granted at the previous amount established before the suspension. The Supreme Court ordered the dismissal of the admissibility objection without addressing the substantive legal question, leaving the lower court’s handling of the individual case unaffected by a binding interpretative ruling.
