The High Court of Cassation and Justice dismissed as inadmissible the reference for a definitive interpretation submitted by the Constanţa County Court. The dispute concerned whether unpaid wage differences resulting from the recalculation of allowances based on a specific reference salary could be paid in full through a single financial operation, challenging the interpretation of Article 1 of Emergency Governmental Ordinance No. 3/2019. The Court determined that the submission did not meet the procedural requirements for a binding interpretation under Article 521(3) of the Code of Civil Procedure, leaving the lower court to resolve the matter without a definitive legal interpretation from the supreme judicial body.
