Updated net civil service pensions for auxiliary judicial staff: Inflation indexation for 2019–2020 permitted under Law 567/2004 notwithstanding Emergency Order 59/2017
Legislator summary
AI generatedThe Supreme Court of Romania (High Court of Cassation and Justice), acting as the Complete Bench for resolving issues of law, admitted the reference submitted by the Vaslui Court of Appeal and ruled that Article IX(1) of Emergency Government Order No. 59/2017 does not preclude the granting of updated net civil service pensions for auxiliary specialized court staff whose retirement applications were registered on or after September 15, 2017, specifically allowing for indexation with the average annual inflation rate for 2019 and 2020. This decision resolves a legal dispute concerning the eligibility of judicial support staff for pension adjustments under specific transitional measures, establishing that the general prohibition on new pension increases during the crisis period does not apply to cases arising from applications filed after the cutoff date specified in the legislation. The court's determination was based on the interpretation and application of Article 685(10) of Law No. 567/2004 in conjunction with Articles IX and X of Emergency Government Order No. 59/2017, creating a mandatory precedent under Article 521(3) of the Code of Civil Procedure.
