Appeal in the interest of the law admitted: ex officio conversion of contractual posts to public office by 1 Jan 2020 upheld as binding obligation.
Legislator summary
AI generatedThe High Court of Cassation and Justice (Înalta Curte de Casaţie şi Justiţie) admitted the appeal in the interest of the law filed by the Managing Board of the Alba Iulia Court of Appeal, establishing a mandatory interpretation of art. 612(1) of the Administrative Code. The court ruled that the transformation of contractual positions into public office positions, under art. 406 of the Administrative Code, was a legal obligation that public authorities and institutions had to fulfill ex officio by 1 January 2020, and that where they failed to do so, persons who occupied such contractual positions before that date (as referred to in art. 407) may request, under the law, the acquisition of public servant status through the transformation of their post. The decision, which is binding under art. 517(4) of the Civil Procedure Code, resolved divergent judicial practice concerning the retroactive or self-executing nature of the conversion obligation.
