The Supreme Court of Romania dismissed as inadmissible the preliminary ruling request filed by the Court of Appeal of Constanța, thereby leaving the lower court’s pending assessment of the insolvency plan unresolved by this body. The dispute concerned the interpretation of the Law on Insolvency Prevention and Insolvency Procedures, specifically whether claims registered under a suspensive condition must be included and provisioned within a reorganization plan. The decisive legal basis for the dismissal was Article 521 paragraph (3) of the Code of Civil Procedure, which governs the admissibility requirements for such preliminary ruling requests, indicating that the specific question regarding Articles 102, 111, 133, and 165 of the Insolvency Law did not meet the procedural criteria for a compulsory binding interpretation.
