The High Court of Cassation and Justice, ruling on a preliminary question referred by the Court of Appeal Pitești, partially admitted the referral and held that Article 23 of Government Decision No. 281/1993 does not become applicable to specialized auxiliary staff of courts and prosecutor’s offices through the repeal of Article 42 of Law No. 50/1996; the referral was dismissed as inadmissible regarding the condition of establishing domicile or residence for recognizing the right under Article 23. The dispute concerned the scope of a prior statutory provision after its repeal, specifically whether repealed benefits for auxiliary personnel survived via a general regulation. The decision, binding under Article 521(3) of the Civil Procedure Code, rests on statutory interpretation of repeal effects, clarifying that the abrogation did not trigger the application of the Government Decision to that personnel category.
