The High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the Prosecutor General and established a binding interpretation: for single offenses under Articles 289–292 of the Criminal Code (corruption-related offenses), where multiple normative modalities of the material element are realized on different dates, the date of the offense—and thus the starting point for the statute of limitations on criminal liability under Articles 174 and 154(2) of the Criminal Code—is the date of the first alternative modality, irrespective of any subsequent realization of other modalities or the time interval between acts; where a single modality consists of a succession of acts, the date is that of the first act. The decision is mandatory pursuant to Article 474(4) of the Criminal Procedure Code.
