The High Court of Cassation and Justice, sitting as a panel for preliminary rulings on questions of law, dismissed as inadmissible the joined referrals from a lower administrative and labor court, thereby refusing to issue a preliminary ruling on whether a claimant must be classified as auxiliary teaching staff (early-education caregiver) with full corresponding salary rights from 1 January 2024, given the absence of an approved position in the staffing chart, specific legislation regulating classification conditions, study requirements, duties, and job framework, or methodological norms. The dispute arose in two labor-administrative cases challenging the claimant's employment classification and seeking salary differences. The court held the referrals inadmissible under the procedural conditions for preliminary rulings (Civil Procedure Code), without reaching the merits, and declared the decision binding under Article 521(3) of the Civil Procedure Code.
