Admissibility of preliminary reference on equal pay for identical work in public sector employment under Framework Law 153/2017
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible a reference for a preliminary ruling requested by the Constanța Court of Appeal, leaving the procedural path for the lower court to resolve the merits independently. The underlying civil dispute concerned a public sector employment law issue, specifically whether the salary level for a public servant holding the position of Librarian I within a mayor's specialized apparatus could be set at the maximum salary paid for similar positions in other public institutions subordinated to the same budgetary authority. The decisive legal analysis focused on the interpretation of Article 39(1) and Article 6(1) of Framework Law No. 153/2017 regarding the remuneration of public sector staff, in conjunction with the salary structure for public functions as detailed in Annex No. III, Chapter II(b) of the same law, where the Court determined that the admissibility requirements for a preliminary reference under Article 521(3) of the Code of Civil Procedure were not met.
