The High Court of Cassation and Justice dismissed as inadmissible all connected referrals for preliminary rulings submitted by various courts of appeal, leaving the lower instances' procedural stances intact without a substantive resolution on the merits. The dispute centered on labor law conflicts regarding the entitlement to financial benefits such as surcharges, daily allowances, and accommodation costs for personnel on missions abroad, governed by unpublished government decisions, and the specific issue of whether the limitation period for these claims is triggered objectively by the birth of the right or subjectively by the creditor's knowledge of it. The court declined to interpret the interplay between the limitation periods under Decree No. 167/1958 and the limitation rules of the Civil Code, specifically whether the latter's subjective element applies to rights established by normative acts not published in the Official Gazette, thereby rendering the sesizări inadmissible under Article 521(3) of the Code of Civil Procedure.
