The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Bucharest Tribunal, leaving no substantive legal determination on the matter. The dispute concerned whether public sector employees entitled to hardship allowances under specific government and framework salary laws are automatically entitled to corresponding additional rest leave. The decisive legal basis for the dismissal was the inadmissibility of the referral, which precluded any analysis of the interpretation of Article 18(1) of Government Decision No. 250/1992 or Articles 4(1) of Chapters VIII in Annexes V and VI of Framework Laws No. 153/2017 and No. 284/2010, respectively, pursuant to procedural rules in Article 521(3) of the Code of Civil Procedure.
