The High Court of Cassation and Justice dismissed as inadmissible the public interest appeal filed by the Prosecutor General regarding the interpretation and application of fiscal codes concerning building tax assessments. The dispute concerned whether the taxable value of non-residential buildings could be re-established based on an evaluation report for the same fiscal reference year if no physical or legal status changes had occurred, after the tax had initially been determined using the transfer price from the property acquisition deed. The court ruled on the admissibility of the challenge to the interpretation of Article 460(5)(b), (d) and (6) of the Fiscal Code and Paragraph 38 of the Methodological Norms under Government Decision No. 1/2016, leaving the underlying judicial interpretation in force as the appeal was not permitted to proceed.
