Inadmissibility of preliminary referrals on compensatory salary gaps under Law 153/2017 for the Justice occupational family
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible two referrals for preliminary rulings submitted by lower courts, leaving the underlying labor disputes pending at the referring tribunals. The first challenge concerned the application of Law No. 153/2017 to determine whether a compensatory sum should cover the difference between net salary income in May 2018 and February 2018, and whether this compensation should be calculated based on net salary or net income. The second challenge questioned whether the same provision applies to the "Justice" occupational family and whether compensatory sums are due when net income differences arise from the judicial capping of salary rights or statutory limitations on bonuses, regardless of the calculation date. The court's decision was grounded in Article 521(3) of the Civil Procedure Code, which mandates such referrals, but found the procedural requirements for the preliminary reference to be unmet.
