The High Court of Cassation and Justice dismissed the referral from the Bucharest Court of Appeal as inadmissible, leaving the lower court's procedural status unchanged. The dispute concerned the interpretation and application of Emergency Government Ordinance No. 48/2022, specifically whether legal penal interest could be awarded alongside the inflation index for outstanding salary differences owed to state teaching staff for the period between July 1, 2017, and August 31, 2021. The decisive legal basis was Article 521(3) of the Code of Civil Procedure, which governs the admissibility requirements for referrals to the High Court regarding conflicts of law.
