The High Court of Cassation and Justice, acting as the Complete Panel for Deciding Matters of Law, dismissed as inadmissible the request for a preliminary decision (decizie prealabilă) filed by the Constanța Court of Appeal regarding whether personal assistants for persons with severe disabilities, employed by local administrative units, are entitled to the meal allowance under the Public Sector Salary Framework Law. The dispute involved a civil labor law issue concerning the applicability and effective date (from January 1, 2019) of the meal allowance provision (Article 18(1) of Law No. 153/2017) to such specific employees. The court relied on Article 521(3) of the Civil Procedure Code to declare the session inadmissible, thereby leaving the legal question unresolved by this body and forcing the referring court to address the matter through standard appellate or cassation channels.
