Base-salary increases cannot cumulate in same month; 15% complexity increase foreclosed by 50% project increase.
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the joined referrals and ruled, in a preliminary ruling for the uniform interpretation of law, that the 15% base-salary increase for work complexity cannot be granted for a month in which the official already received an increase of up to 50% of the base salary for work on projects funded by non-reimbursable European funds; this decision is binding under Art. 521(3) of the Civil Procedure Code. The dispute concerned the cumulative application of pay increases under Annex VIII, Chapter I, Section II, Note 2, points 2 and 3 of Law No. 153/2017, read with Art. 16(1) of that law and Art. 4(1) of the Framework Regulation approved by Government Decision No. 325/2018, in cases where both increases were triggered in the same month. The court held that the two increases are mutually exclusive for the same period, given the legislative intent to avoid double compensation for the same work intensity.
