Judicial pension calculation: exclusion of pre-magistrate lawyer service periods after 2024
Legislator summary
AI generatedThe High Court of Cassation and Justice of Romania, in its Plenary for Resolving Questions of Law, admitted a preliminary reference from the Bucharest Tribunal and definitively held that the period during which a magistrate-assistant served as a lawyer cannot be counted toward pension entitlement calculation for service periods after January 1, 2024. This decision resolves a dispute regarding the interpretation of judicial status laws and pension regulations, specifically addressing the exclusivity of pension rights for the post-2024 period under the amended Legal Framework. The court’s ruling is based on Article 86 of Law No. 303/2004 (republicated), Article 282(3) of Law No. 303/2022 in relation to Article 211(1) of the same law as modified by Law No. 282/2023, and the Fiscal Code, establishing that the relevant period is excluded from pension calculations except for the specific derogation provided in Article II of Law No. 282/2023; the judgment is mandatory under Article 521(3) of the Code of Civil Procedure.
