The High Court of Cassation and Justice partially admitted the referral from the Pitești Court of Appeal for a preliminary ruling and, interpreting Article 30(1)(i) of Law No. 263/2010, held that pension rights vested before Law No. 197/2021 took effect may be recalculated under Article 107(3) of Law No. 263/2010, with entitlement to all benefits specific to crediting service performed in special conditions—namely, the determination of the contribution period under Article 56(1)(d) and the increase of monthly scores under Article 100(1)(b) of that law. It dismissed as inadmissible the referral regarding whether recalculation under Article II of Law No. 351/2022 extends to all such benefits or is limited to the benefit in Article 56(3)(d) of Law No. 263/2010. The ruling is binding under Article 521(3) of the Civil Procedure Code; the operative outcome favors pension claimants seeking full special-conditions benefits upon recalculation.
