The High Court of Cassation and Justice, sitting in a panel for preliminary ruling on questions of law, admitted the referral from the Cluj Court of Appeal and held that Article 129(12) of Emergency Ordinance No. 57/2019 (the Administrative Code) does not permit a local council to grant, by council decision, bonuses and facilities not regulated by other legal norms. The decision is binding under Article 521(3) of the Civil Procedure Code. The underlying dispute concerned a challenge to a local council decision granting such unregulated benefits; the court ruled that this provision authorizes only remuneration and benefits expressly established by law, not discretionary additions by local authorities.
