The High Court of Cassation and Justice dismissed as inadmissible the referral for a preliminary ruling on points of law submitted by the Argeș County Court. The dispute concerned civil enforcement proceedings, specifically whether an entity that was not a party to the original judgment constituting the enforceable title could acquire debtor status solely through a claim for late payment penalties under Article 906(2) and (3) of the Code of Civil Procedure, and whether the resulting court order is final or subject to appeal. The decisive legal basis for the dismissal was the procedural requirement under Article 521(3) of the Code of Civil Procedure, which governs the admissibility of referrals for the resolution of points of law.

Completul pentru dezlegarea unor chestiuni de drept

Minuta deciziei nr. 93 Dosar nr. 1951/1/2024

Ședința din 25 noiembrie 2024

ÎN NUMELE LEGII

DECIDE:

521 alin. (3) din Codul de procedură civilă.

Pronunțată în ședință publică astăzi, 25 noiembrie 2024.
