The High Court of Cassation and Justice, acting through its Plenum for the resolution of legal questions, admitted the referral from the Court of Appeal of Constanța and issued a binding precedent interpreting the limitation period for challenging administrative acts. The dispute concerned an action for annulment filed by the State Secretariat for the recognition of merits of those who fought against the communist regime against a newly issued certificate, with the core legal issue being whether such an action is subject to a limitation period and, if so, which one applies. The Court ruled that an action for the annulment of the "new certificate," as defined in the norms methodological to the Law on gratitude for the victory of the Romanian Revolution, applies the one-year limitation period (*termen de decădere*) prescribed by Article 1(6) final sentence of Law No. 554/2004 regarding administrative litigation, by interpreting Article 8(5) of Law No. 341/2004 in relation to Article 491(1)(b) of the Annex to Government Decision No. 1412/2004.
