The High Court of Cassation and Justice, sitting as the Full Court for the Settlement of Legal Issues, admitted the preliminary referral filed by the Buzau Tribunal and decisively established that community pharmacies selling veterinary medicines are subject to sanitary-veterinary and food safety control, thereby resolving the legal uncertainty and mandating compliance by the referring court. The dispute, arising in civil proceedings, concerned the applicability of specific contraventional regulations to pharmacies, requiring an interpretation of whether such entities fall within the scope of sanitary-veterinary oversight when handling veterinary drugs. The court’s ruling, which is obligatory for all courts pursuant to Article 521(3) of the Code of Civil Procedure, is grounded in the interpretation of Article 6(1)(b) of Government Order No. 984/2005 regarding the establishment and sanctioning of contraventions to sanitary-veterinary and food safety norms, explicitly including community pharmacies within the regulatory perimeter of these controls.
