The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by a labor tribunal, meaning the referring court must proceed without the requested clarification from the full panel. The dispute concerned the interpretation of the framework law on public sector salaries, specifically whether the leadership allowance for budget-funded functions within the "Justice" occupational family is determined according to Article 10, paragraph (1), letter (b) of Section 2 of Annex V to the Framework Law No. 153/2017. The decisive legal basis was the procedural inadmissibility of the referral under Article 521(3) of the Code of Civil Procedure, which governs the conditions for binding preliminary rulings by the full court on questions of law.
