The High Court of Cassation and Justice, sitting as the Plenary for Resolving Legal Questions, partially admitted the connected referrals from the Bucharest and Iași District Courts and established a binding interpretation regarding the entitlement to hazardous condition allowances in the public sector. The dispute concerned the calculation and granting of surcharges for personnel working in exceptionally hazardous conditions within the "Health and Social Assistance" occupational family, specifically challenging the legal framework for determining these bonuses. The Court ruled that such personnel are entitled to a hazard allowance ranging from 50% to 75% of their base salary, as provided by Law 153/2017 and Government Decision 153/2018, contingent upon the existence of official determination or expert certificates from authorized authorities. The Court further clarified that while the right to the allowance is statutory, the specific obligation to determine the exact amount rests with the credit manager (budget holder). The decision is obligatory for all courts pursuant to Article 521(3) of the Civil Procedure Code, and the referrals were rejected in all other respects.
