The High Court of Cassation and Justice (ICCJ) admitted the appeal in the interest of law filed by the leadership of the Galati Court of Appeal, establishing a mandatory uniform interpretation of the law. The dispute concerned the validity of recalculating a partial early retirement pension originally granted under specific conditions, challenging whether the pension could be recalculated using different statutory provisions within the same law. The court ruled that it is legally impermissible to recalculate a partial early retirement pension established under Article 65(1) and (4) of Law No. 263/2010 regarding the public pension system by applying the provisions of Article 65(5) of the same act.
