The High Court of Cassation and Justice dismissed as inadmissible two joined referrals from the Constanța Court of Appeal, leaving the procedural posture of the underlying civil disputes unresolved. The referrals sought to resolve two distinct legal questions regarding the calculation of leave allowances: first, whether surcharges for difficult conditions, isolation, night shifts, and risk compensation must be included in the base for calculating paid leave for prison administration staff, and second, whether a food allowance granted to teaching and auxiliary staff between January 2019 and June 2023 should be included in the calculation of leave allowances. The Court’s decision is grounded in Article 521(3) of the Code of Civil Procedure, which governs the admissibility requirements for referrals concerning the resolution of legal issues, concluding that the submissions did not meet the necessary procedural or substantive thresholds for the Court to intervene.
