The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling on a question of law submitted by the Bucharest Court of Appeal, thereby leaving the lower court to resolve the case without binding guidance from the supreme judicial body. The dispute concerned labor law and social insurance, specifically whether Constitutional Court Decision No. 261/2022 produces legal effects during the period between February 27, 2021, and June 10, 2021, for an employee who had not initiated litigation regarding their right to an age-limit allowance under Article 49 of Law No. 96/2006 prior to the publication of that constitutional decision. The procedural basis for the dismissal was Article 521(3) of the Code of Civil Procedure, which governs the admissibility requirements for references to the High Court's Panel for Resolving Questions of Law.
