The High Court of Cassation and Justice dismissed as inadmissible the connected referrals submitted by the Giurgiu Tribunal and the Cluj Court of Appeal, rejecting the request for a preliminary ruling on the legal issue of recalculating public officials' leave allowances by including food benefits in the calculation base. The dispute concerned a procedural mechanism to resolve divergent interpretations regarding the inclusion of specific benefits in the average salary base for leave compensation, but the superior court determined that the referrals did not meet the admissibility requirements for a binding preliminary decision under the Code of Civil Procedure. The operative outcome is a procedural dismissal, leaving the lower courts without the requested uniform interpretation, based strictly on procedural admissibility grounds rather than a substantive ruling on the calculation methodology.
