The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling submitted by the Bucharest Court of Appeal in a labor and social security dispute. The case centered on whether salary increases for extraordinary operational or supplementary work performed by special status personnel were mandatory under a specific ministerial order, even when such payments exceeded the allocated budgetary funds. The decisive legal basis involved the interpretation of Articles 5 and 6 of the relevant internal affairs ministerial order regarding salary conditions, evaluated in conjunction with the procedural framework for resolving questions of law, which the Supreme Court found procedurally non-compliant, thereby leaving the matter to be resolved by the referring court without a binding pre-judicial decision.
