Eligibility of prior police legal service for judicial pension: cumulation of military and magistrate pensions under Law 303/2004
Legislator summary
AI generatedThe High Court of Cassation and Justice, sitting in its Full Bench for resolving matters of law, partially admitted a referral from the Alba Iulia Court of Appeal and determined that service periods in specialist legal functions held by a police officer with a law degree may be counted toward the calculation of a magistrate’s service pension under Article 82(3) of Law No. 303/2004, provided those duties met the statutory requirements of Article 44(1) of Law No. 92/1992, while rejecting the second issue on the admissibility of cumulative pensions. The dispute centered on whether prior military state pension service periods, already valued for a police officer, create an impediment to subsequently claiming a service pension upon admission to the judiciary, against the backdrop of Articles 86, 104(1), and 51(3) of Law No. 303/2004 and Article 192(1) of Law No. 263/2010. The decisive legal basis relies on the interpretation of Articles 82 and 86 of Law No. 303/2004 in conjunction with the professional qualification standards of the judicial organization law, establishing that the nature of the prior legal duties, rather than the former employer, governs the eligibility for pension calculation.

DECIDE:

În interpretarea şi aplicarea dispoziţiilor art. 82 alin. (3) raportate la dispoziţiile art. 86 şi art. 104 alin.
51 alin.
