The High Court of Cassation and Justice rejected as inadmissible the preliminary reference submitted by the Ialomița Tribunal regarding the interpretation of the governing body composition for a branch of a foundation. The dispute concerned whether, under Article 18(2) of Government Ordinance No. 26/2000, the board of directors of a branch established by a foundation must be distinct in its composition from the board of directors of the parent foundation. By ruling the submission inadmissible, the court did not resolve the substantive legal question, thereby leaving the lower court to determine the issue without a binding interpretation from the supreme court.
