The High Court of Cassation and Justice, acting through its Full Bench for Resolving Legal Questions, admitted the preliminary reference from the Oradea Court of Appeal and established the mandatory interpretation of Art. 266(4¹) of Law No. 207/2015 regarding the Fiscal Procedure Code, in conjunction with Art. 23(3)-(4) of the same Code, resolving the referenced dispute in the negative for the tax authorities' interest. The core issue concerned whether the annulment of fiscal obligations owed by an individual debtor operating independently, resulting from their deregistration during a bankruptcy or preventive insolvency procedure, allows for the subsequent assumption of those debts by the natural person; the Court ruled that the specific application of Art. 181 of Law No. 85/2014 (the Insolvency Law, in its pre-2022 amendment form) legally impedes such an assumption of obligations.
